About Clergy Sexual Abuse

Clergy sexual abuse involves a clergy member abusing their power to sexually abuse or exploit a church member. Those accused of sexual misconduct often include priests, church officials, or other Catholic clergy employees. The list of victims often includes sexual misconduct involving minors or a vulnerable adult.

Reporting sexual misconduct involving those in power helps initiate change and prevent future victims from also being harmed. Those accused of sexual misconduct should be subject to criminal charges and, in many cases, civil compensation. Alaska allows those assaulted or abused by clergy members to seek compensation for financial and emotional damages.

Rosenfeld Injury Lawyers has the expertise and compassion needed to handle sensitive child sexual abuse cases involving assault, sexual pornography, or inappropriate relationships against clergy members. Our legal team offers a comprehensive representation of claims relating to clergy sexual abuse, including investigation, collection of evidence, and trial representation.

Laws and Regulations in Alaska

State Law A.S. 47.17. 020 requires mandatory reporters to report sexual misconduct involving minors immediately. This includes priests and clergy members, as sexual abuse is not included in the clergy-penitent privilege in Alaska. Sexual misconduct involving minors or vulnerable adults must be reported within 24 hours. Any suit alleged abuse involving exploitation, assault, neglect, or child pornography must be reported according to Alaska law.

Alaska is one of a few U.S. states without a statute of limitations on criminal cases involving serious sexual offenses. However, Alaska does have a three-year statute of limitations on civil suit claims filed based on sexual abuse. The three-year time limit begins once the victim reaches 18 years of age.

Filing a Clergy Sexual Abuse Lawsuit in Alaska

If you or a loved one were the victim of sexual misconduct involving minors or vulnerable adults, it may be worth filing a civil lawsuit. Here is what you can expect:

  • The first step in a clergy sexual misconduct case is to report the abuse to the appropriate authorities. This allows law officials to investigate child sexual abuse or inappropriate sexual behavior and serve criminal justice.
  • The next step is to contact a clergy sexual abuse lawyer. Alaska victims may also be subject to civil compensation through a clergy sexual abuse lawsuit, especially when church officials attempt to cover up credibly accused perpetrators’ wrongdoing.
  • During your initial consultation, your lawyer will review your case and any available evidence and discuss the best legal options. If you decide to work together, they’ll begin a deep investigation into the pending claims.
  • Most clergy sexual abuse cases are settled outside of court. However, if the church or clergy members are unwilling to offer a fair settlement, your legal team will ensure the civil suit is filed as needed and begin preparing you for court.

Notable Cases and Outcomes in Alaska

There have been published lists of Catholic Church Dioceses who were accused of sexual misconduct in Alaska. An independent review found that 14 Catholic Church members in Anchorage, Alaska, alone, were guilty of sexual misconduct. Many of the cases involved abusive priests who worked in positions of power, namely parishes, schools, or shelters. The victims included both children and vulnerable adults.

The list consists of those credibly accused over the last 54 years, making it difficult for victims to seek justice. In Alaska villages, a clergy was accused of sexual misconduct spanning over multiple generations. Multiple claims have been filed against The Society of Jesus, which eventually led to a $50 million payout. However, the Fairbanks diocese filed bankruptcy, only paying out $10 million of the amount owed.

Multiple admitted offenders are on the Fairbanks diocese’s list. An updated Fairbanks diocese list and bankruptcy reorganization docs show additional pending claims, showing that there may be even more church officials accused of sexual abuse.

Our attorneys have reviewed public and private settlement data related to Alaska diocese clergy abuse settlements. Depending on the circumstances pertaining to your case, these cases may be valued between $400,000 and $950,000. In cases of extreme conduct or by taking a case in front of a jury, your damages could increase to $1 million.
