About Clergy Sexual Abuse

California Clergy sexual abuse includes a misuse of power to sexually abuse or exploit a child or vulnerable adult in the church. Numerous priests have been accused of sexual abuse in California, including in Los Angeles, San Francisco, San Jose, and Santa Rosa.

When proven guilty, offenders are subject to criminal charges and civil claims. Sexual abuse lawyers play an important role in helping California abuse victims overcome a history of being sexually abused in the church. The legal system gives child victims a voice to overcome clergy abuse.

A civil suit alleges abuse occurred and aims to seek justice through the financial recovery of damages. While receiving compensation doesn’t forgive the abuse, civil or private settlements can help victims pay for the resources they need to assist in recovery. Credible accusations also help bring light to a bigger problem while ensuring the accused can no longer hold that same power over other members.

Laws and Regulations in California

California laws aim to protect victims of sexual misconduct and abuse. The California Child Victims Act recognizes that it can take decades for victims of child abuse to come forward. Years of healing and recovery are usually required before a victim is comfortable making accusations of abuse. The act allows victims to seek damages from both the priests accused and any clergy members or officials found guilty of covering for a person accused.

In January 2020, California passed the AB218 bill, which extended the statute of limitations for child sexual abuse victims. It also created a three-year lookback window, which has since expired.

Many felony sexual misconduct and assault cases involving children in California don’t have a statute of limitations. This means that victims of child sexual assault can file criminal charges at any time. Rosenfeld Injury Lawyers is here to help clergy sexual abuse victims report, investigate, and recover damages.

Filing a Clergy Sexual Abuse Lawsuit in California

Filing a clergy sexual abuse lawsuit in California brings light to a larger problem, helping others seek justice and protect future generations from the same abuse. A civil suit includes the following steps:

  • Contact Rosenfeld Injury Lawyers – Our law firm offers a free, confidential consultation and represents those seeking justice against California priests.
  • Investigation – The California legal system presumes priests accused of sexual abuse are innocent until proven guilty. Investigation into the alleged abuse allows us to prove guilt through witness reports, personal statements, and diocese records. Reviewing published accused priests lists also allows us to consider other situations in which survivors filed suit against the same priest accused.
  • Settlement – Clergy officials commonly settle with victims to keep prior abuse quiet. However, settlement offers can hide a history of sexually abusing children in the church.
  • Trial – Should you or your loved one decide to present your case in front of a jury, our legal team will prepare and represent you every step of the way.

Notable Cases and Outcomes in California

California has a lengthy history of clergy abuse, many of which have led to lawsuits and settlement offers. A Los Angeles list of credibly accused victims led to the archdiocese paying millions of dollars in settlement offers to over 500 abused victims. The Diocese of Orange settled 90 cases of abuse. The Saint Anthony Seminary and Los Angeles Archdiocese have also been the subject of sexual abuse settlement cases. Pedophile priests, troubled priests, and clergy official cover ups paint a distrusting picture, and our team is here to help seek justice.

More recently, California dioceses have also been releasing their own lists, bringing to light the priests accused over decades of church services. Many California dioceses have also filed for bankruptcy following an influx of accused priests, making it important to consider your legal options soon. Our attorneys have reviewed public and private settlement data related to California clergy abuse settlements. Depending on the circumstances of your case, these cases may be fairly valued in the $400,000 to $950,000 range. In cases of extreme conduct or if your case were to go before a jury, damages could exceed $1 million.
