About Clergy Abuse
Clergy sexual abuse is inappropriate and illegal sexual misconduct by church officials to their congregants. This sexual abuse can be towards anyone within the church, but many cases of this abuse by clergy members are towards minors. Adult and child sexual abuse has been proven to leave lasting impacts on the survivors.
Reporting sex abuse from clergy members doesn’t happen as often as the abuse does. Reporting adult or child sex abuse and then working with abuse attorneys like Rosenfeld Injury Lawyers is the first step to seeking justice and healing. Our lawyers will guide you through the legal process in Louisiana, which includes reporting, gathering evidence, and potentially going to trial if the case can’t be settled outside of court.
Legal Support for Survivors in Louisiana
Rosenfeld Injury Lawyers is here to provide legal support to survivors of clergy abuse in Louisiana. We have a combination of experience, knowledge, and compassion that allows us to handle these sensitive cases with the care they deserve while we tirelessly seek justice.
Laws and Regulations in Louisiana
In 2021, Lousiana passed the Lousiana Child Victims Act. This eliminated the statute of limitations for child sexual abuse. It also helped create a three-year “look back” window for survivors who wanted to file lawsuits. The window for this act is set to close in 2024. There might be a disruption in this act, though. The Louisiana Supreme Court has come out and stated that it cannot be retroactively applied because the church’s “property right” is not to be sued.
Like other states, Louisiana also has mandatory reporters. Individuals in specific lines of work like healthcare, law enforcement, religious roles, educators, and anyone who works with children are required to report any suspected abuse to help protect kids.
Filing a Clergy Sexual Abuse Lawsuit in Louisiana
When you or a loved one are ready to come forward about the clergy abuse, there are specific steps that you’ll need to take to ensure your best shot at getting justice:
- Attorney Consultation: Hire an attorney and law firm that has experience with clergy abuse cases and that you can trust. Have your initial consultation so they can hear your case and determine the best way to proceed with getting justice.
- Evidence Gathering: You and your attorney will gather as much evidence of the abuse as possible to build a strong case against the clergy member or other church official.
- Officially Filing a Complaint: Your attorney will officially file a complaint with the abuser and even the Catholic Church if they believe the organization is partially responsible.
- Discovery Period: Both parties will have the chance to review all evidence and statements from both sides before moving to settlement negotiations.
- Settlement or Jury Trial: Your case will move to settlement negotiations, where you’ll hopefully get a fair settlement outside of court. If both parties can’t come to an agreement, the case can go before a jury.

Survivors in Louisiana aren’t alone. There are several great support resources that survivors can utilize after clergy abuse, regardless of how long ago it was. Survivors will find crisis hotlines, support groups, and specialized counseling services that can help them process what happened and begin to heal from the trauma. There are some state-wide, regional, and national options, but some great support resources in Louisiana are:

- The Victim Assistance Program from the Louisiana Attorney General
Notable Cases and Outcomes in Louisiana
There have been too many incidents of clergy abuse cases in Louisiana. The church substantiates some of these alleged abuse cases, while others haven’t been. Whether they’ve been substantiated by the church or not, they’re all still important. Some notable cases and outcomes in Louisiana are:
- St. Martin De Tours Catholic Church: The names of survivors aren’t usually publically released, but Doug Bienvenu shared his story over 40 years after it happened. He was sexually abused by a priest who was working at the St. Martin De Tours Catholic Church when he was nine years old. This case has spawned a lawsuit against the Lafayette Diocese, which is still under investigation.
- The Lafayette Diocese: Following the above case, Bienvenu has since heard from many others who were abused while attending churches within the Lafayette, LA Diocese. There are five other St. Martinvile survivors who have abuse claims against the same priest, Father Kenneth Morvant, who is deceased. They have remained anonymous. Even though there were multiple incidents of abuse from Morvant, the Lafayette Diocese left his name off their 2019 list of credible priests accused. This has spawned an additional investigation into the Lafayette Diocesan review board. The Louisiana Supreme Court has agreed to review the case, but the lawsuit status is still pending.
Our attorneys at Rosenfeld Injury Lawyers have reviewed public and private settlement data related to Louisiana clergy abuse settlements. Depending on the specifics of your case, settlements for these types of cases are valued between $400,000 and $950,000. In extreme misconduct cases or if your case goes before a jury, settlements might exceed $1 million.
